The Clermont County Juvenile Court proposes to adopt Local Rule 37 on August 18, 2023. The Rule authorizes the issuance of emergency orders for custody, parenting time, or companionship time.  The term “emergency” is defined in the Rule to mean:

1) there is an imminent or immediate risk of significant harm to the physical, emotional, or mental health of the child who is the subject of the Motion; and

2) the interest and welfare of the child requires that action be taken immediately before the adverse parties or their attorney(s) are notified.

The Motion must be accompanied by an affidavit. The Rule sets forth the process that must be followed before the Court will consider such a Motion.
